From time to time our commercial clients inevitably become embroiled in disputes relating to their business affairs. Cosgrove Gaynard Solicitors have extensive experience in all areas of commercial litigation and dispute resolution practice in Ireland providing a pro active, results orientated and cost efficient service to clients.

Our approach is to clearly identify the strengths and weaknesses of a case as soon as possible to determine the best strategy for our client whether it be early settlement, full litigation, mediation, negotiation or other dispute resolution process. At all times our focus is to keep legal costs on both sides at a minimum.Cosgrove Gaynard Solicitors have the capacity and flexibility to deal to small and large matters alike and have represented clients in civil and commercial litigation matters in the District Court, Circuit Court , High Court and Commercial Court. We also act in emergency matters for clients such as injunctions and asset freezing/ seizure claims.

The process used in commercial litigation depends on the circumstances of each individual case. In some circumstances the parties may want to continue to conduct business together after the dispute and so mediation would be a suitable forum to resolve the issue. In other cases it is more suitable to resolve litigation cases with a full hearing as quickly as possible and the recently formed commercial court presents a suitable forum whereby proceedings can be fast tracked once certain criteria are met.

The Commercial Court

The Commercial Court is a division of the High Court and was established in 2004 to provide efficient and effective dispute resolution in commercial cases. It is governed by Order 63A of the Rules of the Superior Courts in particular.
